Portfolio work displayed on this Site may include work created for third-party clients. All rights to that work remain with Alkalyne Design and/or the respective client as governed by individual project agreements.
4. Services and Project Agreements
The information presented on this Site regarding our services is for general informational purposes only and does not constitute a binding offer or contract. All design, development, and fabrication services are subject to separate project agreements, proposals, or statements of work agreed upon between Alkalyne Design and the client prior to commencement of work.
Alkalyne Design reserves the right to decline any project inquiry at our discretion.
5. Accuracy of Information
We make reasonable efforts to ensure the information on this Site is accurate and up to date. However, we make no warranties or representations of any kind regarding the completeness, accuracy, or reliability of any content on the Site. We reserve the right to modify, update, or remove content at any time without notice.
6. Third-Party Links and Services
Our Site may contain links to third-party websites and may integrate third-party tools including contact forms and chat functionality powered by GoHighLevel, and analytics tools powered by Google. These third-party services operate under their own terms and privacy policies. Alkalyne Design is not responsible for the content, practices, or policies of any third-party services or websites.
7. SMS / Text Message Communications
By providing your mobile phone number and submitting a form on our Site, you agree to receive text messages (SMS/MMS) from Alkalyne Design related to your inquiry, project, or other business and promotional communications. This section governs all SMS communications between you and Alkalyne Design.
7.1 Consent and Opt-In
You are not required to consent to receive SMS messages as a condition of purchasing any goods or services from Alkalyne Design. Consent is obtained at the time you submit a contact or inquiry form on our Site by checking the designated SMS consent checkbox and providing your mobile phone number.
By opting in, you confirm that you are the account holder or have the account holder’s permission to opt in to SMS communications on the mobile number provided.

Alkalyne Design is not responsible for any fees, charges, or overages assessed by your carrier in connection with SMS messages you receive from us. Please contact your carrier if you have questions about your messaging plan.
7.5 Opting Out
You may opt out of receiving SMS messages from Alkalyne Design at any time by replying STOP to any message we send. Upon receiving your opt-out request, you will receive a single confirmation message and no further text messages will be sent, except as required by law.
To re-subscribe after opting out, reply START or re-submit your consent through a form on our Site.
Please note that opting out of SMS communications does not affect any other communications we may have with you via email or other channels.

7.7 Prohibited Use and Content
Alkalyne Design will not use SMS communications to send any of the following types of content:

- Sexually explicit, obscene, or offensive material
- Harassing, threatening, or abusive content
- Content that promotes illegal activity
- Phishing attempts or fraudulent communications

Additionally, you agree not to use any SMS communications from Alkalyne Design for unlawful purposes or in any manner inconsistent with these Terms.
7.8 Carrier Liability
Alkalyne Design’s SMS communications are delivered through third-party messaging platforms and mobile carrier networks. Mobile carriers are not liable for delayed or undelivered messages. Delivery of SMS messages is subject to effective transmission and the capabilities of your mobile network. Alkalyne Design is not responsible for any delays, failures, or errors in message delivery caused by your carrier or network conditions.
7.9 Privacy and Data Sharing
Your mobile phone number and any information you provide in connection with SMS communications will not be sold, rented, or shared with third parties or affiliates for their own purposes. Your number may be passed to our SMS service provider (GoHighLevel) solely for the purpose of delivering messages on our behalf, in accordance with our Privacy Policy.
7.10 Changes to SMS Terms
We reserve the right to modify these SMS terms at any time. Material changes will be reflected in the “Last Updated” date at the top of this page. Continued receipt of messages after changes are posted constitutes your acceptance of the revised terms. You may opt out at any time as described in Section 7.5.
8. Disclaimer of Warranties
This Site and all content on it are provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
Alkalyne Design does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.
9. Limitation of Liability
To the fullest extent permitted by applicable law, Alkalyne Design shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of or inability to use the Site, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising out of or relating to these Terms or the Site shall not exceed the amount you have paid to Alkalyne Design in the twelve months preceding the claim, or $100, whichever is greater.
10. Indemnification
You agree to indemnify, defend, and hold harmless Alkalyne Design and its owner from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with your access to or use of the Site, your violation of these Terms, or your violation of any third-party rights.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Los Angeles County, California.
